The Electoral Commissions and Afghan Government Are Wasting Time for Electoral Reform

FEFA’s leadership met with the Mr. Fazel Ahmad Manawi, Minister of Justice of the Islamic Republic of Afghanistan on February 15, 2021 to talk about the amendment of the election law. FEFA had previously developed a proposal on amendment of the election law and submitted to the Ministry of Justice for considering it at the time of amending the election law. FEFA’s proposal included recommendations on separating the election law from the law on the structure, authorities and duties of election commissions, changing the electoral complaints commission to a temporary commission during election period, decreasing the members of election commission from 7 to 5, recommending to mechanisms for appointment of members of the commission, and recommendations on amendment of all articles of the law on the election. At the beginning of the meeting, Mr. Naeem Asghari, acting director of FEFA talked about the importance of amendment the election law and avoiding wasting time. He stated that reforming the election law is the first step for electoral reform. Therefore, the Afghan government must prevent delay in reforming the election law. The asked the Ministry of Justice to request the election commission to submit their proposal on amendment of the election law to pave the way for commencement of the reforming process. Then the Minister of Justice stated that FEFA’s proposal on amendment of the election law is inclusive and its incorporation into the election law can help prevent the previous electoral deadlocks. He added that FEFA’s concerns over delay in brining electoral reform is right and said, “It is the time for electoral reform but some stakeholders like to delay the process.” He promised to invite FEFA’s representatives to the meetings on amendment of the election and added that FEFA as a technical election observation organization has always had a positive role on transparency of election process.
