Legislative problems in National Assembly

The most important duties of legislative power are legislation, overseeing the performance of government and representation of the people. The legislative power of Afghan state has its own strengths and weaknesses. This paper reviews the weaknesses of the Afghan parliament and makes recommendations to strengthen the Afghan parliament in legislative affairs. We have held desk researches and read a series of analyses to come up with thorough recommendations on strengthening legislation in the National Assembly of Afghanistan. This paper reviews the nature, structure, and performance of legislative power and then assesses the legislative shortcomings and problems. The paper divides the legislative problems of the Afghan parliament into 2 categories (Internal category and external category). Reforming the political, legal, cultural and management system of the country along with the legislative system are perquisites of empowering legislative power in Afghanistan. 1. Foreword This paper assesses the legislative shortcomings of Afghanistan. It compares the legislative system of Afghanistan with other countries such as the United States of America, and presents recommendations to solve legislative problems in Afghanistan. Inconsistency, laws requiring multiple reform efforts, incomprehensive laws, contradictory and ambiguous laws and procedures, failure to conform to the hierarchy of laws, failure to get laws fully implemented, and legislative delay are major governing problems in Afghanistan. To remedy these shortcomings, this paper makes a series of recommendations, such as setting rules on legislation, handling draft laws professionally, devising a mechanism to match draft laws with previous legislative documents, and refining existing legislation. 2. History of Legislation in Afghanistan Rule of Sharia law has a history of 14 centurey in Afghanistan and from the first days of converting into Islam, people of Afghanistan commenced following sharia law. However, legislation and making laws has a history of less than 90 years. Legislation began in the reign of Amir Amanullah Khan in Afghanistan.
